This circular relates to the use of licensed property conveyancers to carry out conveyancing work under the provisions of the Crown Employees (Transferred Officers Compensation) Award.
With effect from the date of this circular, I have approved of the use of licensed property conveyancers to carry out conveyancing work. Organisations are reminded that in terms of the Crown Employees (Transferred Officers Compensation) Award, conveyancing costs, whether incurred by using licensed property conveyancers or private solicitors, will only be refunded where an approach in the first instance, has been made to the Crown Solicitor's Office.
Changes to the conveyancing licensing regulation adopted in 1994, have not been available to transferred officers. My Office therefore, will consider on a case by case basis, any applications for refunds on behalf of transferred officers who have used licensed property conveyancers since 1 December 1994.
