C1997-15 Non-Eligibility of Long-Term Temporary Staff of Ministers' and former office Holders for Appointment as Public Service officers under the Public Sector Management (General) Amendment (Special Appointments) Regulation 1996

(Circular to all Ministers, Chiefs of Staff and Former Office Holders)

Clause 10A of the Public Sector Management (General) Regulation 1996 allows for appointment of long-term temporary employees as public service officers on the recommendation of the Department Head. (Premier's Department Circular 97-2).

It is the intention of the regulation that long-term temporary employees are eligible appointment where, inter alia, on-going work is available in respect of the employee in an officer's position in the Department and the Department Head is satisfied as to the employee's suitability.

Given the nature of the employment arrangements of staff in Ministers' Offices and of former office holders, this regulation does not apply on the basis that:

1. On-Going Work: It is not possible to decide that on-going similar work is available,

2. Environment: Work performed in these offices does not establish the employee's suitability for different work in the Department.
