Detailed Outline
1. INTRODUCTION
On 6 June 1997, in proceedings before the NSW Industrial Relations Commission, the Public Employment Office and the Public Service Association of NSW (PSA) entered into a consent award. The award is to be known as the Crown Employees (Public Sector - Salaries June 1997) Award and has a term of 3 years from 1 January 1997 to 31 December 1999.
The new Award covers all employees covered by the Crown Employees (Public Sector Salaries - August 1995) Award. A total pay increase of 16% is available to all employees covered by the Award.
2. OPERATION
This Circular gives details of the Crown Employees (Public Sector Salaries - June 1997) Award ('the Award') and authorises Chief Executive Officers to pay the increases in salaries, wages and allowances of:
- 1% with effect from the first pay period to commence on or after 1 January 1997; and
- a further 3% with effect from the first pay period to commence on or after 1 July 1997,
as outlined in clause 3 below.
The pay increases apply to all employees covered by the Crown Employees (Public Sector Salaries - August 1995) Award and to employees under the:
- Education Officer Department of Training and Education Co-ordination Determination No. 912 of 1996
- Officers Who Crew Research Vessels Determination No. 908 of 1996
- Senior Officers NSW Public Service Determination No. 910 of 1997
- Special Olympic Trainees NSW Public Service Determination No. 913 of 1997
Some classifications under this Award are covered by the PSA with other unions. All employees covered by these classifications receive the increases.
Pay schedules for some key classifications are contained in Attachment C for information.
Please note that the Award does not cover:
- classifications covered by other awards or other industrial instruments to which the PSA is not a party.
- staff covered by Federal awards/agreements;
- persons employed by the New South Wales Lotteries Corporation;
- persons employed as general assistants in schools;
- persons falling within the operation of the Rural Lands Protection Boards Salaries and Conditions Award 1997; or
- enterprise bargains with the Public Service Association, unless provided for in point 9.
It is acknowledged that NSW Health is continuing to discuss with the PSA the application of this Award to certain groups.
The first two pay increases which are effective from the first pay period to commence on or after 1 January 1997 and 1 July 1997 are covered by this Circular. Advice on the further increases available under the Award will be provided closer to their implementation date.
3. METHODS OF ADJUSTMENT - SALARIES AND WAGES
(1) SALARIES - ANNUAL RATES
(a) annual salaries except for those specified in paragraph (b) below, shall be increased as follows:
i. an increase of one per cent (1%) shall apply to all rates of pay, with effect from the beginning of the first pay period to commence on or after 1 January 1997.
ii. an increase of three per cent (3%) shall apply to all rates of pay, with effect from the beginning of the first pay period to commence on or after 1 July 1997.
All annual rates are to be rounded off to the nearest dollar, with figures less than 50 cents going to the lower amount, and with figures 50 cents or more going to the higher amount.
(b) Junior rates, calculated as a percentage of an adult rate
These rates are to be increased in accordance with their percentage.
(c) Junior rates, other than those calculated on a percentage basis
These rates are to be increased as specified in 1(a) above.
(2) WAGES - WEEKLY RATES
(a) weekly wages except for those specified in paragraph (b) below, shall be increased as follows:
i. an increase of one per cent (1%) shall apply to all rates of pay, with effect from the beginning of the first pay period to commence on or after 1 January 1997.
ii. an increase of three per cent (3%) shall apply to all rates of pay, with effect from the beginning of the first pay period to commence on or after 1 July 1997.
All weekly rates are to be rounded off to the nearest 10 cents, with figures less than 5 cents going to the lower amount, and with figures 5 cents or more going to the higher amount.
(b) Junior rates, calculated as a percentage of an adult rate
These rates are to be increased in accordance with their percentage.
(c) Junior rates, other than those calculated on a percentage basis
The rates are to be increased as specified in 2(a) above.
4. METHODS OF ADJUSTMENT - ALLOWANCES
Allowances listed in Attachment A titled 'Allowances Subject to Adjustment', may be adjusted as follows, in the manner indicated:
(a) an increase of one per cent (1%) shall apply to all rates of pay, with effect from the beginning of the first pay period to commence on or after 1 January 1997.
(b) an increase of three per cent (3%) shall apply to all rates of pay, with effect from the beginning of the first pay period to commence on or after 1 July 1997.
(1) SHIFT ALLOWANCES
(a) Shift allowances expressed as a percentage of a salary or wage shall continue to be calculated as a percentage of such salary or wage.
(b) Annual shift allowances shall be rounded off to the nearest dollar, with figures less than 50 cents to go to the lower amount and with figures 50 cents or more to go to the higher amount.
(c) Weekly shift allowances shall be rounded off to the nearest 10 cents, with figures less than 5 cents to go to the lower amount and with figures 5 cents or more to go to the higher amount.
(d) In the case of sums expressed as payable per shift or per hour, they are to be converted to a weekly equivalent and adjusted in the manner indicated above. The resultant figure is to be divided by five or the appropriate number of weekly hours normally worked, as the case may be.
(2) OTHER ALLOWANCES
(a) Allowances expressed as a percentage of a salary or wage shall continue to be calculated as a percentage of such salary or wage.
(b) Allowances expressed as a formula or by reference to a salary or wage shall continue to be calculated as specified in the relevant Award, Agreement or Determination.
(c) Annual allowances shall be rounded off to the nearest dollar, less than 50 cents to go to the lower amount and 50 cents or more to go to the higher amount.
(d) Weekly allowances shall be rounded off to the nearest 10 cents, less than 5 cents to go to the lower amount and 5 cents or more to go to the higher amount.
(e) In the case of sums expressed as payable per shift or per hour, such sums shall be converted to a weekly equivalent, adjusted in the same manner indicated above for weekly rates. The resultant figure is to be divided by five or the appropriate number of weekly hours normally worked by that classification, as the case may be.
5. EXCLUDED ALLOWANCES
Those allowances listed in Attachment B titled 'Allowances Not Subject To Adjustment', are not to be adjusted.
6. OVERTIME
The overtime barrier will be -
i. $48,441 per annum with effect from the beginning of the first pay period to commence on or after 1 January 1997.
ii. $49,894 per annum with effect from the beginning of the first pay period to commence on or after 1 July 1997.
7. PART-TIME AND CASUAL EMPLOYEES
In those cases where an industrial instrument (including a letter of approval of the PEO) specifies the method by which a part-time or casual rate shall be determined, such part-time or casual rates are to be increased in terms of such specification.
All other part-time and casual rates will be considered separately upon application to the PEO.
8. STAFF RECEIVING SALARY MAINTENANCE
Staff who are receiving salary maintenance to a salary rate subject to adjustment by this circular are to have their salaries adjusted in line with the above instructions.
9. ENTERPRISE BARGAINS
A number of enterprise industrial instruments contain savings clauses. A typical provision is
'Should there be a variation to the Crown Employees (Public Sector Salaries 1995) Award, or an Award replacing it, during the term of this Award, by way of salary increase, or other benefit to the public service, this Award shall be varied to give effect to any such salary increase, or other benefit, from the operative date of the variation of the former Award, or replacement Award.'
These enterprise instruments are also to receive the increases under the Crown Employees (Public Sector Salaries) Award 1997.
Enterprise instruments made under the 1991 Industrial Relations Act may be closed and you will need to approach PEO for consideration of whether increases are to be applied to these enterprise specific industrial instruments. PEO has determined that Court Reporters and Sheriffs Officers are also to receive these increases.
