Detailed Outline
1. INTRODUCTION
As you are aware, the Crown Employees (Public Sector - Salaries June 1997) Award was made on 6 June 1997, in proceedings before the NSW Industrial Relations Commission, with the consent of the Public Employment Office and the Public Service Association of NSW (PSA). The new Award covers all employees covered by the Crown Employees (Public Sector Salaries - August 1995) Award.
Further, I refer to Circular No. 97-30 issued 11 June 1997 concerning pay increases available under the Crown Employees (Public Sector - Salaries June, 1997) Award, and now authorise payment of 2% with effect from the first pay period to commence on or after 1 January 1998. This 2% increase is to be met from agencies' existing budgets and is to be offset from savings not based on reductions to service delivery.
These savings are to be identified from agencies across a broad range of corporate service areas with specific attention to:
- purchasing & procurement;
- property management;
- human resource management & processing,
- financial management & account processing;
- information management & technology; and
- general administration.
As you are aware discussions have occurred between your organisation and the Corporate Services Reform Unit of Premier's Department. Further assistance is available from Dr E Coombs on telephone number (02) 9228 3096 or Ian Peters on (02) 9228 3530 on the employee relations aspects.
The pay increases apply to all employees covered by the Crown Employees (Public Sector Salaries - August 1995) Award and to employees under the:
- Education Officer Department of Training and Education Co-ordination
- Determination No. 912 of 1996
- Officers Who Crew Research Vessels Determination No. 908 of 1996
- Special Olympic Trainees NSW Public Service Determination No. 913 of 1997
- Crown Employees (Senior Officers 1997) Award
Some classifications under this Award are covered by the PSA with other unions. All employees covered by these classifications receive the increases.
Pay schedules for some key classifications are contained in Attachment C for information.
Please note that the Award does not cover
classifications covered by other awards or other industrial instruments to which the PSA is not a party;
(6) ongoing arrangements are documented; and
(7) the relevant trade union is consulted, as appropriate, on any implications of the proposed variation of hours for the work area.
(f) Natural emergencies and major transport disruptions --- A staff member prevented from attending work at a normal work location by a natural emergency or by a major transport disruption may:
(1) apply to vary the working hours as provided in paragraph (e) of subclause (iii) of this clause and/or
(2) negotiate an alternative working location with the department; and/or
(3) take available family and community service leave and/or flex leave, recreation or extended leave or leave without pay according to the provisions of clause 14, Leave of this award to cover the period concerned.
(g) Assistance with transport --- The extent of any assistance by the department with transport of a staff member between the workplace and residence or part of the distance involved, shall be determined by the Department Head according to the provisions contained in clause 15, Shift Work and Overtime of this award.
(iii) Notification of Absence from Duty
(a) If a staff member is to be absent from duty, other than on authorised leave, the staff member must notify the supervisor, or must arrange for the supervisor to be notified, as soon as possible, of the reason for the absence.
(b) If a staff member is absent from duty without authorised leave and does not provide an explanation of the absence to the satisfaction of the appropriate Department Head, the amount representing the period of absence shall be deducted from the staff member=s pay.
(iv) Public Holidays
(a) Unless directed to attend for duty by the Department Head, a staff member is entitled to be absent from duty on any day which is:
(1) a public holiday throughout the State; or
(2) a local holiday in that part of the State at or from which the staff member performs duty; or
(3) a day between Boxing Day and New Year=s Day determined by the appropriate Department Head as a public service holiday.
(b) A staff member, who is required by the Department Head to work on a local holiday may be granted time off in lieu on an hour fme-->
3. METHODS OF ADJUSTMENT - ALLOWANCES
Allowances listed in Attachment A titled 'Allowances Subject to Adjustment', may be adjusted as follows, in the manner indicated:
an increase of two per cent (2%) shall apply, with effect from the beginning of the first pay period to commence on or after 1 January 1998.
(1) SHIFT ALLOWANCES
(a) Shift allowances expressed as a percentage of a salary or wage shall continue to be calculated as a percentage of such salary or wage.
(b) Annual shift allowances shall be rounded off to the nearest dollar, with figures less than 50 cents to go to the lower amount and with figures 50 cents or more to go to the higher amount.
(c) Weekly shift allowances shall be rounded off to the nearest 10 cents, with figures less than 5 cents to go to the lower amount and with figures 5 cents or more to go to the higher amount.
(d) In the case of sums expressed as payable per shift or per hour, they are to be converted to a weekly equivalent and adjusted in the manner indicated above. The resultant figure is to be divided by five or the appropriate number of weekly hours normally worked, as the case may be.
(2) OTHER ALLOWANCES
(a) Allowances expressed as a percentage of a salary or wage shall continue to be calculated as a percentage of such salary or wage.
(b) Allowances expressed as a formula or by reference to a salary or wage shall continue to be calculated as specified in the relevant Award, Agreement or Determination.
(c) Annual allowances shall be rounded off to the nearest dollar, less than 50 cents to go to the lower amount and 50 cents or more to go to the higher amount.
(d) Weekly allowances shall be rounded off to the nearest 10 cents, less than 5 cents to go to the lower amount and 5 cents or more to go to the higher amount.
(e) In the case of sums expressed as payable per shift or per hour, such sums shall be converted to a weekly equivalent, adjusted in the same manner indicated above for weekly rates. The resultant figure is to be divided by five or the appropriate number of weekly hours normally worked by that classification, as the case may be.
4. EXCLUDED ALLOWANCES
Those allowances listed in Attachment B titled 'Allowances Not Subject To Adjustment', are not to be adjusted.
5. OVERTIME
The overtime barrier will be $50,892 per annum with effect from the beginning of the first pay period to commence on or after 1 January 1998.
6. PART-TIME AND CASUAL EMPLOYEES
In those cases where an industrial instrument (including a letter of approval of the PEO) specifies the method by which a part-time or casual rate shall be calculated, such part-time or casual rates are to be increased in terms of such specification.
All other part-time and casual rates will be considered separately upon application to the PEO.
7. STAFF RECEIVING SALARY MAINTENANCE
Staff who are receiving salary maintenance to a salary rate subject to adjustment by this circular are to have their salaries adjusted in line with the above instructions.
8. ENTERPRISE BARGAINS
A number of enterprise industrial instruments contain savings clauses. A typical provision is
'Should there be a variation to the Crown Employees (Public Sector Salaries 1995) Award, or an Award replacing it, during the term of this Award, by way of salary increase, or other benefit to the public service, this Award shall be varied to give effect to any such salary increase, or other benefit, from the operative date of the variation of the former Award, or replacement Award.'
These enterprise instruments are also to receive the increases under the Crown Employees (Public Sector Salaries, June 1997) Award.
Enterprise instruments made under the 1991 Industrial Relations Act may be closed and you will need to approach PEO for consideration of whether increases are to be applied to these enterprise specific industrial instruments. PEO has determined that Court Reporters and Sheriffs Officers are also to receive this increase.
The PEO is able to assist you if you have any difficulty in establishing whether a classification or individual is covered by the increase. Please contact your client contact officer for this and any other inquiries.
