Circular 99-49 details a number of measures which are designed to eliminate any discrimination in superannuation for NSW public sector employees and former employees aged 65 years and over. Circular 99-49 also applies to members and former members of Government boards and committees and the payments outlined in the Circular will need to be made to affected members and former members who satisfy the criteria detailed in the Circular. As indicated in the Circular any amounts which may already have been paid to employees or former employees in lieu of First State Superannuation Scheme contributions or superannuation guarantee payments must be taken into account to ensure that employees are not compensated twice.
Memorandum 99-3 includes details of superannuation payments for government board and committee members. The superannuation arrangements advised in Circular 99-49 supersede that part of Memorandum 99-3 which refers to Superannuation Guarantee contributions for persons aged 70 years or older.
It would be appreciated if you would bring this circular to the attention of all Officers in your administration responsible for board appointments and remuneration and request that they ensure appropriate payments are made to the current and former board and committee members who are referred to in Circular 99-49.
