C2004-26 Employer Representatives to the Government and Related Employees Appeal Tribunal

Detailed Outline

The purpose of this Circular is to advise you of the new employer representatives for the Public Employment Office ("PEO") to the Government and Related Employees Appeals Tribunal ("GREAT"). The employer representatives are members of the Tribunal in its proceedings on discipline and promotion matters.

The PEO is defined in the GREAT Act as the employer of staff employed by Departments listed in Schedule 1 of the Public Sector Employment and Management Act 2002, for the purposes of membership of GREAT.

The list of new employer representatives for the PEO is attached. It is important that the employer representatives are readily available for any appeal proceedings involving NSW Government Departments. The term of appointment to the panel is until 9 October 2007.

The successful nominees have been advised separately in writing.

When your Department is respondent in an appeal, you must select a person from the list as the employer's representative and notify the Registrar of the Tribunal accordingly. That person may be from your Department (if listed) or from another Department. There is no restriction on who you may select. If you select a retired person, your Department will be required to pay that person the following fee:

  • $75 per half day (up to four hours duration); or
  • $126 per day (more than four hours on any one day).

Where a panel representative is unable to continue, the Government and Related Employees Appeal Tribunal Act 1980 requires the person to submit a resignation in writing to the Registrar of the Tribunal.

A copy of the resignation should also be forwarded to the Public Employment Office, Premier's Department for action together with a recommended replacement. The replacement panel representative must be nominated within one month of the occurrence of a vacancy and they will fill the vacancy for the remainder of the term of the panel.

Any changes to contact details for the panel representatives should be forwarded to the Public Employment Office as soon as is possible to ensure the details of the employer representatives remain up to date.

The Public Employment Office will also separately seek regular confirmation of the currency and accuracy of details of the panel representatives with those Departments who have submitted successful nominations.
