Superability of extended leave at double pay

Premier's Circular 2004-45 advised agencies of the new arrangements following the acceptance of the Government's offer of settlement in relation to the PSA public sector salary claim. The Circular advised agencies of a number of changes to conditions of employment, including pro-rata extended leave and extended leave at double pay. The Circular advised agencies that the double payment would not be superable.

Detailed Outline

Superability of extended leave at double pay

Premier's Circular 2004-45 advised agencies of the new arrangements following the acceptance of the Government's offer of settlement in relation to the PSA public sector salary claim. The Circular advised agencies of a number of changes to conditions of employment, including pro-rata extended leave and extended leave at double pay. The Circular advised agencies that the double payment would not be superable.

The PEO has now received detailed legal advice which indicates that the double payment is superable for employees covered by the First State Superannuation Act 1992 only. These employees are members of First State Super or another complying fund of their choice.

Consistent with Circular 2004-45, the double payment is not superable for members of the closed NSW public sector superannuation schemes, which are established by the Police Regulation (Superannuation) Act 1906, the State Authorities Non-contributory Superannuation Act 1987, the State Authorities Superannuation Act 1987 and the Superannuation Act 1916.

Travel and meal and related allowances

Circular 2005-31 advised Schedule 1 Departments of changes to the travel and meal and related allowances provided under the Crown Employees (Public Service Conditions of Employment) Award 2002. The base level rate for the Community Language Allowance in Item 17 should read $958 for 1 July 2005 and not $937 as appeared in 2005-31. The revised rate for the Community Language Allowance is effective from 1 July 2005, and Circular 2005-31 has now been updated on the Premier's Department website to reflect this change. Please amend any hard copies of Circular 2005-31 accordingly.
