C2005-36 Crown Employees Wages Staff (Rates of Pay) Award 2005

Detailed Outline

The purpose of this Circular is to advise relevant agencies that on 2 September 2005 a Memorandum of Understanding (MOU) was finalised between the NSW Government, Unions NSW and affiliate unions for staff covered by the Crown Employees Wages Staff (Rates of Pay) Award (see attached Schedule A).

The MOU is couched in almost identical terms to the MOU entered into on 21 December 2004 by the NSW Government and the Public Service Association (PSA) for salaried staff and provides for:

  • Rates of pay increases of 4 % per annum over 4 years fully funded and backdated to 1 July 2004. Back pay will only apply to employees who were employed as at 1 July 2005. Former employees who have left prior to 1 July 2005 are not entitled to back pay.
  • Enhanced non-salary conditions of:
    • the introduction of paid parental leave of 1 week at full pay or 2 weeks at half pay;
    • an increase in paid maternity and adoption leave to 14 weeks at full pay or 28 weeks at half pay;
    • access to pro-rata extended leave after 7 years service;
    • allowing employees to take a period of extended leave at double pay, i.e. an employee may use their entitlement to 2 months extended leave by taking 1 months leave and receiving 2 months pay for that 1 month period; and
    • public holidays that fall whilst an employee is on a period of extended leave will be paid and not debited from an employees leave entitlement.

These enhanced non-salary conditions will become available to employees who have an entitlement to commence the relevant form of leave on or after 1 July 2005 and will be implemented in line with those provided to PSA salaried staff (refer C2004-45 Public Sector Salaries Award Settlement of Claim with The Public Service Association and C2005-33 in respect of superability of extended leave at double pay).

For staff employed under the Crown Employees Wages Staff (Rates of Pay) Award 2005 whose non-salary conditions are covered by the Ministerial Uniform Leave Conditions policy, the policy will be amended to reflect the enhancements to parental, maternity and extended leave as set out above.

An application for a new award will be made to the NSW Industrial Relations Commission shortly. In the interim, the PEO has determined that agencies may implement the rate of pay increases and enhanced conditions as soon as practicable.

The increases in rates of pay are shown in the attached Schedule B and increases to work related allowances which move in line with rates of pay increases (such as disability and skill related allowances) are in the attached Schedule C.

Expense related allowances (such as meal allowances), which move independently to increases in rates of pay in line with the National Building and Construction Award and other relevant awards, have been updated to reflect most recent increases and are in the attached Schedule D.

Rates of pay and allowances for organisation specific industrial instruments not covered by the Crown Employees Wages Staff (Rates of Pay) Award are not affected.
