The NSW Government's Economic and Financial Statement of February 2006 implemented a policy change applying to Chief and Senior Executive Service (SES) Officers who are removed from office and subsequently declared unattached. This circular is to clarify the arrangements to apply to SES officers where the unattachment is not due to the officer's proposed removal from office.
Detailed Outline
The NSW Government's Economic and Financial Statement of February 2006 implemented a policy change applying to Chief and Senior Executive Service (SES) Officers who are removed from office and subsequently declared unattached. This circular is to clarify the arrangements to apply to SES officers where the unattachment is not due to the officer's proposed removal from office.
In accordance with the policy announcement the maximum period any SES officer can remain unattached, where the officer is to be removed from the service will be up to four weeks. This Circular also applies to members of the Police Senior Executive Service (PSES) as well as the Health Executive Service (HES).
The SES Guidelines are available on the Premier's Department website (in the publications section under Chief and Senior Executive Service), and will be amended to reflect this change.
Exemptions will only be approved in limited circumstances where:
(i) there is an agreement to allow an officer to use existing leave entitlements prior to retirement or an extended period of sick leave; or
(ii) circumstances involved are required to benefit the public sector, such as the secondment of the officer to undertake the duties of another substantive position in their agency or another agency, or a similar arrangement such as a public inquiry.
In the case of (i) above, unattachment is the only administrative vehicle available which would allow an agency to substantively fill the vacancy once the officer commenced pre-retirement leave. In such cases, the unattached officer would not be entitled to compensation determined by the Statutory and Other Offices Remuneration Tribunal.
Any proposed exemptions from this policy will need to be submitted to the Director-General of Premier's Department.
