C2007-02 Public Sector Salaries Award

Detailed Outline

On 1 February 2007 the NSW Industrial Relations Commission made the Crown Employees (Public Sector - Salaries 2007) Award by consent. The award is part of the settlement of the 2004 PSA public sector salary claim.

The award corrects errors in the Crown Employees (Public Sector - Salaries 2004) Award and also provides for a 4% increase to salaries and related allowances with effect from the beginning of the first full pay period on or after 1 July 2007 (as per the Memorandum of Understanding entered into between the Government and the PSA, in December 2004).

The Awards, Agreements and Determinations that will receive the pay increases are listed in Attachment A. Pay schedules for some key classifications subject to adjustment are contained in Attachment B for information. Attachment C sets out allowances that are to be adjusted in line with salaries.

1. SALARY AND WAGE RATES SUBJECT TO VARIATION

Only rates of pay contained in the attached schedule of Awards, Determinations and Agreements are to be increased (Attachment A).

Please also note that the salaries agreement does not cover:

  • classifications covered by other awards or other industrial instruments;
  • staff employed under the Crown Employees (Institute Managers in TAFE) Salaries and Conditions Award.

Some Awards, Agreements, Determinations, Enterprise Agreements and other forms of industrial instruments NOT listed in Attachment A may have provisions to vary salaries consequent to variations to the public sector salaries award. They may have provisions like:

'Rates of pay will be adjusted in accordance with the Crown Employees (Public Sector - Salaries 2004) Award or any award replacing that award.'

The Director of Public Employment (DPE) has determined that Department's may grant increases to classifications under those instruments pending formal application for variation.

The Public Employment Office should be contacted if organisations wish to seek advice on whether rates of pay under particular industrial instruments should be adjusted in line with the 2007 Award.

Agencies should also ensure that they report new salary rates for employees to Pillar Administration to ensure that the increased salaries are taken into account for superannuation purposes.

The errors in the Crown Employees (Public Sector - Salaries 2004) Award that were corrected are mostly rounding errors of a few dollars and agencies are generally paying employees correctly. Agencies should review and adjust any underpayments. Overpayments are to be ignored.

2. METHODS OF ADJUSTMENT - SALARIES AND WAGES

2.1 Salaries - Annual Rates
Annual salaries, except for those specified below, shall be adjusted by an increase of four per cent (4%), with effect from the beginning of the first pay period to commence on or after 1 July 2007.

All annual rates are to be rounded off to the nearest dollar, with figures less than 50 cents going to the lower amount, and with figures 50 cents or more going to the higher amount.

Junior rates, calculated as a percentage of an adult rate
These rates are to be adjusted in accordance with their percentage relative to the adult rate.

Junior rates, other than those calculated on a percentage basis
These rates are to be adjusted as specified in the normal way.

2.1.1 Wages - Weekly Rates
Weekly wages, except for those specified below, shall be adjusted by an increase of four per cent (4%), with effect from the beginning of the first pay period to commence on or after 1 July 2007.

All weekly rates are to be rounded off to the nearest 10 cents, with figures less than 5 cents going to the lower amount, and with figures 5 cents or more going to the higher amount.

Junior rates, calculated as a percentage of an adult rate
These rates are to be adjusted in accordance with their percentage relative to the adult rate.

Junior rates, other than those calculated on a percentage basis
The rates are to be adjusted as specified in the normal way.

2.2 Adjustment of Allowances

Allowances listed in Attachment B titled 'Allowances Subject to Adjustment', shall be adjusted by an increase of four per cent (4%), with effect from the beginning of the first pay period to commence on or after 1 July 2007.

Those allowances listed in Attachment C titled
'Allowances Not Subject To Adjustment' are not to be adjusted.

2.2.1 Shift Allowances

Shift allowances expressed as a percentage of a salary or wage shall continue to be calculated as a percentage of such salary or wage.

Annual shift allowances shall be rounded off to the nearest dollar, with figures less than 50 cents to go to the lower amount and with figures 50 cents or more to go to the higher amount.

Weekly shift allowances shall be rounded off to the nearest 10 cents, with figures less than 5 cents to go to the lower amount and with figures 5 cents or more to go to the higher amount.

In the case of sums expressed as payable per shift or per hour, they are to be converted to a weekly equivalent and adjusted in the manner indicated above. The resultant figure is to be divided by five or the appropriate number of weekly hours normally worked.

2.2.2 Other Allowances

Allowances expressed as a percentage of a salary or wage shall continue to be calculated as a percentage of such salary or wage.

Allowances expressed as a formula or by reference to a salary or wage shall continue to be calculated as specified in the relevant Award, Agreement or Determination.

Annual allowances shall be rounded off to the nearest dollar, less than 50 cents to go to the lower amount and 50 cents or more to go to the higher amount.

Weekly allowances shall be rounded off to the nearest 10 cents, less than 5 cents to go to the lower amount and 5 cents or more to go to the higher amount.

In the case of sums expressed as payable per shift or per hour, such sums shall be converted to a weekly equivalent and adjusted in the same manner indicated above for weekly rates. The resultant figure is to be divided by five or the appropriate number of weekly hours normally worked by that classification.

3. OVERTIME
 
In accordance with Clause 96 of the Crown Employees (Public Service Conditions of Employment) Reviewed Award 2006, the maximum salary rate on which overtime payment may be calculated, is set out below:

  • $73,939 per year with effect from the beginning of the first pay period to commence on or after 1 July 2006.
  • $76,897 per year with effect from the beginning of the first pay period to commence on or after 1 July 2007.

 4. PART-TIME AND CASUAL EMPLOYEES
 
Where an industrial instrument, including a determination of the Director of Public Employment has specified the method or formula for calculating part-time or casual rates, agencies should now adjust the part-time or casual rate according to the formula.
 
All other part-time and casual rates will be considered separately upon application to the Public Employment Office.
 
5. STAFF RECEIVING SALARY MAINTENANCE
 
Staff who are receiving salary maintenance to a salary rate subject to adjustment, are to have their salaries adjusted in line with the above instructions.
