The new Crown Employees (Transferred Employees Compensation) Award 2009 (TECA) was made on 16 July 2009.
The Award reflects Clause 5.3 of the Memorandum of Understanding made in settlement of the Crown Employees (Public Sector – Salaries 2008) Award that the parties replace the Crown Employees (Transferred Employees Compensation) Award with a simplified and modernised award.
The Award also reflects the Recommendation of Justice Boland, President of the Industrial Relations Commission made on 17 September 2008 that the TECA provisions should apply where an employee is directed to relocate. The Award does not apply where an employee transfers as a result of merit selection. There is no entitlement where an employee can reasonably commute to the new location or the old and new locations are part of the metropolitan area.
Time limits to complete transactions have been brought into line with Australian Tax Office limits with discretion for agencies to pay expenses which are out of time where there is a good reason.
The Award will be placed on the Department of Premier and Cabinet website www.dpc.nsw.gov.au under Public Sector Employment Pay and Conditions.

All Departments listed in Part 1 of Schedule 1 to the Public Sector Employment and Management Act, 2002 and those agencies identified in Attachment 1 of the Memorandum of Understanding in settlement of the Crown Employees (Public Sector Salaries – 2008) Award.
