Keypoints
- The Public Sector Employment and Management Act 2002 has been amended by the Public Sector Employment and Management Amendment Bill 2012. Commencing on 11 April 2012, the amendments:
-
- require a department head to be satisfied that there is no suitable on-going position available in the public sector service before terminating an excess public service officer (amended s56)
- exclude the unfair contracts provisions of the Industrial Relations Act 1996 from applying to excess employee arrangements in all public sector agencies (new s103A)
- require the heads of public sector agencies to develop and implement performance management systems for their staff (new s101A)
- require the Public Service Commissioner to issue guidelines on the essential elements of performance management systems in agencies (new s101A)
- limit the search for a position for a public service officer on an excessive salary to an ongoing public sector service position (amended s57).
