C2014-06 Quality Regulatory Services initiative – Guidance for NSW regulators to implement outcomes and risk-based regulation

Description

  • Regulators are to implement an outcomes and risk-based approach to regulation under the Quality Regulatory Services (QRS) initiative.

  • The QRSs response to Industry Action Plans which form part of the NSW Economic Development Framework.

  • Guidance material, including a diagnostic tool, has been developed to assist NSW regulators to implement the initiative supporting a consistent and transparent approach across government.

  • While the approaches will take time to implement fully, there are milestones that must be met by December 2014. These are outlined below.

Detailed Outline

Risk-based approach to compliance and enforcement

In relation to a risk-based approach to regulation, by December 2014 regulators must:

  • Review compliance and enforcement in line with guidance material prepared by Department of Premier and Cabinet (DPC)

  • Publish a policy consistent with the guidance outlining how they will apply a risk-based approach to compliance and enforcement and

  • Commence reporting against the policy

A focus on regulatory outcomes

In relation to an outcomes-based approach to regulation, by December 2014 regulators must:

  • Clearly define the regulatory outcomes they seek to secure, ensuring alignment with objectives of all legislation administered by the regulator

  • Review outcome monitoring mechanisms as part of regulator legislative reviews, and

  • Commence reporting regularly on outcomes

Reporting

Regulators will be required to report to DPC in early 2015 on their achievement against milestones. Further annual reporting on implementation will also be required. Support to implement the requirements will be provided by DPC.
