M1991-12 Consultation Arrangements between State and Federal Governments on Appointments of Judges of the Officials of Other Government

Detailed Outline

Following consultation with the Prime Minister, I have agreed that the following arrangements will apply where one Government appoints an Official or Judge from the other Government to a position which does not require the person to resign e.g a part-time or temporary position with an advisory body or inquiry.

i. Ministers may correspond directly with their counterparts in the other Government or delegate the responsibility within their administrations for those appointments which are essentially personnel matters relating to the day to day administration of portfolios.

ii. Where an appointment is of an exceptional or controversial nature, consultation should first occur at Prime Minister to Premier or Chief Minister level, before a final decision is made to appoint the individual concerned.
Where any cases are brought to you as being covered in (i) above are considered by you to be controversial or exceptional appointments, I would appreciate your advising me before any decision is made.

Please bring this Memorandum to the attention of all relevant departments and authorities within your administration.
