I refer to the Premier's previous Memorandum 1991-12 which dealt with arrangements for consultation between State and Federal Governments for appointments of Officials or Judges from the other Government in situations which do not require the person to resign from their current employment appointments.
This memorandum updates those consultation guidelines, following some Ministerial concerns about particular experiences of application of the guidelines and further consultation with the Federal Government.
- Where an appointment is essentially a matter relating to the day to day administration of portfolios, consultation with Ministerial counterparts or Ministerial delegates of the other government, is appropriate. Such consultation should be undertaken whenever the person to be appointed from the other Government is to undertake duties directly related to the Official's or Judge's field of employment. This applies regardless of whether the person is chosen as a representative of their Government's views, or because of his or her professional and expert status in the field in which they are employed.
- Where an appointment is of an exceptional or controversial nature. consultation should first occur at Prime Minister to Premier or Chief Minister level, before a final decision is made to appoint the individual concerned.
Where any cases brought to you as being covered in (1) above are considered by you to be controversial or exceptional appointments.' the Premier should first be consulted before any decision is made.
