Detailed Outline
I wish to draw your attention to the need to consult the Minister for Industrial Relations about legislative and policy proposals which may have implications for public sector superannuation conditions.
Public sector superannuation is governed by various superannuation Acts and associated legislative instruments. This legislation has been modified over many years to achieve a more uniform and equitable approach to superannuation for all public sector employees.
The Commonwealth Insurance and Superannuation Commissioner determines the conditions with which superannuation funds should comply to be able to take advantage of substantial tax concessions. The penalty for non-compliance with the Commonwealth legislation is the loss of these tax concessions.
To ensure that a consistent approach is maintained and to protect the interests of State superannuation contributors and beneficiaries, all proposals having superannuation policy implications should be referred to the Minister for Industrial Relations for his consideration in the initial stages of development.
For initial advice on superannuation policy matters, the Director, Policy in the NSW Superannuation Office, Mr David McMahon, may be contacted on 262 6877 (facsimile 264 1732).
Please bring this Memorandum to the attention of all relevant departments and authorities within your administration.
