The Building Industry Royal Commission Report includes the following recommendations:
"I recommend that the appropriate New South Wales authority move for deregistration of the BWIU in both the Federal and New South Wales jurisdictions, or the closest appropriate remedy, bearing in mind the complication of the formation of the CFMEU and the coming into force, of the New South Wales (Industrial Relations) Act".
"Commissioner Holland's conclusions about certain officers of the Master Builders' Association of New South Wales in the course of his Report on Collusive Tendering, and my conclusions concerning the Group Apprenticeship Scheme, make it undesirable that the Government should have any dealings with that body or with its officers unless and until there is a proper restructuring of it, and I so recommend.
I further recommend that advice be sought from the State Crown Solicitor as to whether there are grounds for applying to have the Association deregistered as an industrial organisation".
I have arranged for advice to be sought from the Crown Solicitor on the question of deregistration of both the BWIU and the MBA.
Meanwhile, it is my request that all Ministers take steps forthwith to ensure that both organisations are suspended from membership of any Boards, Commissions and Committees and any other consultative mechanisms associated with their administrations.
I would appreciate your cooperation in attending to this matter personally.
In relation to the BWIU it is important to recognise that it is now part of the CFMEU. The EMU Division and BWIU New South Wales Divisional branch of the CFMEU correspond approximately with the previous Federal body and the New South Wales branch of the BWIU.
