The administrative responsibility for the provision of ex gratia legal assistance to Ministers, and public officials is currently shared between my administration and that of the Attorney General.
I have decided, however, that it is more efficient and appropriate for a single Minister, the Attorney General, to have responsibility for such matters. From now on, therefore, any requests for legal assistance should be directed to the Attorney General who will assess the merits of the case and whether or not such assistance should be granted. He will, of course, seek the advice of the Crown law officers on these matters.
The transfer applies to all requests for ex gratia legal assistance in relation to a Minister or a public official.
The cost of providing ex gratia assistance will continue to be met from the existing budgetary allocation of the Minister who has applied for, or recommended, the provision of the assistance.
