In Memorandum 1992-15 departments and authorities were advised that the use of Comcars by NSW Government organisations was to be avoided because the Department of Transport and Comcars were in dispute over the refusal of the Commonwealth to comply with requirements of the NSW law covering hire car services to the public. Comcars were in a position of unfair advantage in the market place compared to private competitors.
The Department of Transport has now successfully negotiated with the Commonwealth Government acceptable arrangements for Comcars to comply with the provisions of the NSW Passenger Transport Act 1990 in regard to any services Comcars supply to any customer that is not a Commonwealth Public Sector organisation.
On the basis of that agreement, NSW departments and authorities may again use Comcars. However. it is pointed out that the NSW Supply Service lets a contract for the provision of hire car services to departments and agencies at competitive rates for a premium service. Where that contractor can supply the service. departments and authorities should utilise the services of the contractor.
