Detailed Outline

This Memorandum draws attention to the attached document entitled: Consulting On Reform - A Consultation Framework for Review of Anti-Competitive Legislation. The consultation framework implements the Government's commitment in the Social Justice Directions Statement October 1996. The purpose of the document is to establish a framework within which agencies are required to conduct their consultations on the review of anti-competitive legislation (competition reviews) required under National Competition Policy. The consultation framework sets out both general principles and minimum requirements for consultation strategies. In general, consultation is required to be commensurate with the regulatory impacts being reviewed and is to be targeted at relevant stakeholders.

Ministers have the primary responsibility for undertaking competition policy reviews, including consultation. Agencies are expected to design consultation strategies for each review consistent with the principles outlined in the consultation framework. Where agencies establish a review team to carry out a review, the review team should be responsible for preparing and implementing the consultation strategy.

The Cabinet Office will review the proposed consultation strategies before they are finalised. In addition, agencies should liaise with The Cabinet Office to ensure that terms of reference and the composition of review groups, where applicable, are suitable before submitting them to Ministers.
