Agencies and authorities must seek the agreement of the Sydney Opera House Trust prior to any proposed use of the Sydney Opera House site or an image (including a photo, stylised representation or recording) of the Sydney Opera House for any official purpose of those agencies or authorities.
Detailed Outline
The Sydney Opera House Trust Act 1961 (the Act) provides for the administration, care, control, management and maintenance of the Sydney Opera House on behalf of the New South Wales Government by the Sydney Opera House Trust pursuant to the Act and the Sydney Opera House Trust By-Law 2010. The By-Law prohibits certain activities on Opera House premises without the approval of the Trust. This includes the conduct of entertainment, instruction or performance and filming for commercial purposes.
In addition to the requirements of the By-Law, the following requirements also apply to government agencies and authorities.
Agencies and authorities must seek the agreement of the Sydney Opera House Trust prior to any proposed use of the Sydney Opera House site or an image (including a photo, stylised representation or recording) of the Sydney Opera House for any official purpose of those agencies or authorities.
Agencies and authorities should note that an official purpose of agencies or authorities includes circumstances where a non-government entity proposes to use the Sydney Opera House site or image as part of a joint venture arrangement, partnership, or other significant arrangement it has with a government agency or authority.
