Challenges and uncertainty coordinating with state agencies, securing necessary enabling infrastructure and navigating the planning system, are some of the issues faced by businesses and investors when it comes to progressing major projects.
The NSW Government is establishing the Investment Delivery Authority to identify and remove barriers that may hinder the successful delivery of major projects, to proactively advise on broader options for system-wide reform, drive productivity, encourage investment and coordinate actions across government,
The purpose of this Memorandum is to establish the Investment Delivery Authority and provide direction to Ministers (and, by consequence, their portfolio agencies) on the approach to deliver against the purpose and objectives of the Authority.
Investment Delivery Authority
The NSW Government has established the Investment Delivery Authority (IDA). The IDA has two distinct but complementary purposes:
to identify and clear barriers to major private, primarily non-residential, investment projects. The IDA will consider major projects from the private sector through an Expression of Interest (EOI) process; and
to advise on reforms that promote investment, competition and productivity in NSW.
The IDA comprises the Secretaries of the Premier’s Department, NSW Treasury and the Department of Planning, Housing and Infrastructure (DPHI), and the Chief Executive, Infrastructure NSW. The IDA will make recommendations to the Treasurer, Minister for Planning and Public Spaces and Minister for Industry and Trade (to be collectively known as the Investment Delivery Authority Approval Committee).
Functions of the IDA
The IDA will:
support the NSW Government to identify and clear barriers for major private, investment projects
advise the NSW Government on options for reform that will promote investment, competition and productivity in NSW
consider projects through an Expressions of Interest (EOI) process that meet the eligibility criteria (as agreed by Government) and make recommendations to the NSW Government about projects to receive fast-track planning assessment and options for non-planning support
monitor and provide oversight of selected projects to ensure delivery and continuous improvement; and
ensure effective cross-sector collaboration and effort occurs to support the delivery of selected projects and on policy reforms and initiatives. This will help identify and address coordination across agencies, remove bottlenecks, and prevent duplication.
The Treasurer, Minister for Planning and Public Spaces and Minister for Industry and Trade (will consider advice and recommendations from the IDA in relation to:
options for planning support and non-planning support for major private, primarily non-residential projects selected through the EOI process; and
options for reform that will promote investment, competition and productivity in NSW.
Directions and recommendations regarding projects will be issued by letter from the Investment Delivery Authority Approval Committee to the relevant Ministers. Ministers and NSW Government agencies are to work constructively and in close collaboration with the IDA to support the consideration of, and delivery of projects, acknowledging the broader public benefit of reducing barriers to major private-sector-led investment projects across NSW.
Projects submitted through the EOI process
It is important to note that any project that is endorsed by the IDA would subsequently be assessed in the ordinary way under the Environmental Planning and Assessment Act 1979 and would need to satisfy all applicable requirements. IDA endorsement does not give rise to an expectation that a project will receive planning approval and/or does not constitute a favourable planning determination.
