I refer to Premier's Memorandum No. 1995-09, issued on 2 May 1995, regarding the continued operation of previously issued memoranda.

Premier's Memoranda to all Ministers apply to public service departments, statutory bodies outside the public service and State Owned Corporations, unless particular memoranda advise otherwise. These memoranda set out Government policy and/or procedural requirements on a wide range of matters and are to be implemented by all public agencies to which they apply.

Chief Executive Officers are not to authorise any departure from Government requirements set out in memoranda unless it is clearly stated that the particular memorandum does not apply to the organisation, or an exemption has been approved by the Public Employment Office. Where there is any doubt about the intended application of a memorandum to an organisation, it should be regarded as applying to the organisation and an exemption may be sought.

Advice about the application of memoranda may be sought, in the first instance, from the contact officer nominated in each memorandum. However, exemptions must he sought in writing by the Chief Executive Officer and departures from Government requirements must not be authorised unless a written approval exempting the organisation from the particular memorandum is issued.
