Description
Section 42S (8) of the Public Sector Management Act 1988, provides that if a former CES/SES officer is re-appointed to the public sector or a State owned corporation or a subsidiary of such owned corporation then that person must reimburse a proportionate amount of the compensation received.

Section 42S (8) of the Public Sector Management Act 1988, provides that if a former CES/SES officer is re-appointed to the public sector or a State owned corporation or a subsidiary of such owned corporation then that person must reimburse a proportionate amount of the compensation received.
To ensure compliance with this section, job applications from former CES/SES officers must be checked with the PEO to determine whether the applicant(s) had received compensation and if so the period the determination covered. Details regarding the proportion to be repaid, should the applicant be successful in gaining selection, would be determined in consultation with the person's former Department.
Under no circumstances is a person to be employed unless arrangements have been made for repayment of a proportionate amount of the compensation.
