It has been brought to my attention that some Agencies may be experiencing confusion in relation to the application of the "right of return" provisions of the Senior Executive Service (SES).
It is stressed that under no circumstances are the right of return provisions available to former SES officers unless they had elected right of return in their initial contract and had been paying for that right. No variation to the provisions is acceptable. For example, it is not permissible for Agencies to keep on the payroll beyond the completion or termination date of a contract an ex-SES officer who did not have right of return, whether or not it is intended to advertise a position for which the person might be qualified and interested. To do so is to provide a quasi right of return.
It would be appreciated if you would bring this information to the attention of appropriate staff within your administration.
In addition, would you please advise me by 31 March 1996 of any acting or temporary or other appointments of former SES officers who did not have right of return and whose contracts had expired or been terminated and which were not the direct result of a vacancy having been advertise And Returns should be sent to Ms Helen Silver, Director, Executive and Ministerial Services, Public Employment Office and include the following information:
NAME OF DATE OF PERSON AND FORMER SES POSITION
DATE OF CESSATION IN SES
POSITION APPOINTED TO AND DATE
