Description
Public Employment Office (PEO) Circular No. 1995-17 gave details of the "Crown Employees (Public Sector- Salaries August 1995) Award" ("the Award") and authorised Chief Executive Officers to pay the increases in salaries, wages and allowances. The purpose of this circular is to prepare public service organizations for the payment of the second increase of 3% under the Award which is effective from the beginning of the first pay period to commence on or after 1 July 1996.
Detailed Outline
1 Operation
Public Employment Office (PEO) Circular No. 1995-17 gave details of the "Crown Employees (Public Sector- Salaries August 1995) Award" ("the Award") and authorised Chief Executive Officers to pay the increases in salaries, wages and allowances. The purpose of this circular is to prepare public service organizations for the payment of the second increase of 3% under the Award which is effective from the beginning of the first pay period to commence on or after 1 July 1996.
2 Adjustment of Salaries, Wages and Allowances
The 3% increase in salaries shall apply to:
- employees who received the first three per cent (3%) under the Award that was effective from the beginning of the first pay period to commence on or after 1 July 1995; or
- employees who subsequently received the increase on the basis of "tradition and practice".
Please note that the Award does not cover:
- areas represented by unions other than the Public Service Association of NSW and the Professional Officers' Association;
- staff covered by enterprise agreements (see clause 9); and
- staff covered by Federal awards / agreements.
Sector-wide and organisational level issues will continue to be progressed under the Framework provided by the Award.
3 Methods of Adjustment - Salaries and Wages
(1) SALARIES - ANNUAL RATES
(a) The basic wage is not adjusted and remains at $121.40 per week ($6334 per annum) as the increase is not a general increase pursuant to sections 14 and 15 of the Industrial Relations Act 1991.
(b) annual salaries except for those specified in paragraph (c) below, shall be increased as follows:
an increase of three per cent (3%) shall apply to all rates of pay, with effect from the beginning of the first pay period to commence on or after 1 July 1996.
All annual rates are to be rounded off to the nearest dollar, with figures less than 50 cents going to the lower amount, and with figures 50 cents or more going to the higher amount.
(c) Junior rates, calculated as a percentage of an adult rateThese rates are to be increased in accordance with their percentage.
(d) Junior rates, other than those calculated on a percentage basis
These rates are to be increased as specified in l(b) above.
Please note that the adjusted salaries of the main classifications and grading structures were attached to PEO Circular No. 95-17 including the adjusted salaries that will be effective from the beginning of the first pay period to commence on or after 1 July 1996. A copy is attached for your convenience.
(2) WAGES - WEEKLY RATES
(a) The basic wage is not adjusted and remains at $121,40 per week ($6334 per annum) as the increase is not a general increase pursuant to section 14 and 15 of the Industrial Relations Act 1991.
(b) weekly wages except for those specified in paragraph (c) below, shall be increased as follows:
an increase of 3% shall apply to all rates of pay, with effect from the beginning of the first pay period to commence on or after 1 July 1996.

The rates are to be increased as specified in 2(b) above.
4 Methods of Adjustment - Allowances
Allowances listed in Attachment A titled "Allowances Subject to Adjustment", may be adjusted in the following manner:
(1) SHIFT ALLOWANCES
(d) Weekly allowances shall be rounded off to the nearest 10 cents, less than 5 cents to go to the lower amount and 5 cents or more to go to the higher amount.
(e) In the case of sums expressed as payable per shift or per hour, such sums
shall be converted to a weekly equivalent, adjusted in the same manner
indicated above for weekly rates. The resultant figure is to be divided by
five or the appropriate number of weekly hours normally worked by that
classification, as the case may be.
5 Excluded Allowances
Those allowances listed in Attachment B titled "Allowances Not Subject To Adjustment", are not to be adjusted.
6 Overtime
The overtime barrier will be $47961 per annum with effect from the beginning of the first pay period to commence on or after 1 July 1996.
7 Part-Time and Casual Employees
In those cases where an industrial instrument (including a letter of approval of the PEO) specifies the method by which a part-time or casual rate shall be determined, such part-time or casual rates are to be increased in terms of such specification.
All other part-time and casual rates will be considered separately upon application to the PEO.
8 Staff Receiving Salary Maintenance
Staff who are receiving salary maintenance to a salary rate subject to adjustment by this circular are to have their salaries adjusted in line with the above instructions.
9 Current Enterprise Agreements and Effect of Section 122 of the Industrial Relations Act 1991
Section 122 of the Industrial Relations Act, 1991, prescribes among other things, that salaries in enterprise agreements be not less than those contained under an award or former industrial instrument.
Organisations are reminded that they should examine the question of whether any adjustments to salaries contained in current enterprise agreements are necessary pursuant to section 122 of the Industrial Relations Act, 1991.
Additionally, some enterprise agreements contain provisions which allow for variations to rates of pay by mutual consent. Agencies are also reminded that they should examine the salaries provisions in enterprise agreements to verify whether the Award has any impact on the these salaries provisions.
