9 Current Enterprise Agreements and Effect of Section 122 of the Industrial Relations Act 1991

Section 122 of the Industrial Relations Act, 1991, prescribes among other things, that salaries in enterprise agreements be not less than those contained under an award or former industrial instrument.

Organisations are reminded that they should examine the question of whether any adjustments to salaries contained in current enterprise agreements are necessary pursuant to section 122 of the Industrial Relations Act, 1991.

Additionally, some enterprise agreements contain provisions which allow for variations to rates of pay by mutual consent. Agencies are also reminded that they should examine the salaries provisions in enterprise agreements to verify whether the Award has any impact on the these salaries provisions.

The PEO is able to assist you if you have any difficulty in establishing whether a clarification or individual is covered by the increases. Please contact your client contact officer for this and any other enquiries.
