C1999-37 Direction to Take Leave - Displaced Employees

Detailed Outline

The purpose of this Circular is to advise you further in relation to directing staff to take accrued recreation (annual) and extended leave (long service leave). This process applies to displaced employees who have been declared excess, declined an offer of voluntary redundancy, are seeking redeployment and there is no work available at their substantive salary.

Declared excess means the employee has been informed in writing that:

  • they are displaced and the Workforce Management Centre notified in accordance with the Managing Displaced Employees Policy (see Premier's Memorandum 96-5); and
  • they are excess to the organisation's needs and have been placed on salary maintenance in accordance with Premier's Department Circular 98-62, Managing Displaced Employees/Salary Maintenance Provisions.

Departments Only
Officers and temporary employees employed under the Public Sector Management Act 1988 may be directed to take accrued recreation leave and extended leave in accordance with the following processes.

Extended Leave:
I have made a Determination under Clause 56 of the Public Sector Management (General) Regulation 1996 that a Department Head may direct a public servant to take any accrued extended leave where:

  • the public servant has been declared excess and there is no work available at their substantive salary level;
  • they have not accepted an offer of voluntary redundancy; and
  • the wishes of the public servant have been taken into account.

The manager/supervisor should consult the staff member being considered for a direction to take accrued extended leave, to obtain their wishes for consideration by the Department Head.

A staff member should be given four (4) weeks notice of a direction to take extended leave. This notice applies also to periods of combined recreation/extended leave.

Recreation Leave:
The Crown Employees (Public Service Conditions of Employment) Award 1997 (the Award) empowers a Department Head, after taking into account the wishes of a staff member, to direct the staff member to take accrued recreation leave at a time convenient to the Department. You should note that under the Award, recreation leave accrues on a daily basis.

The manager/supervisor should consult with the staff member being considered for a direction to take accrued recreation leave, to obtain their wishes for consideration by the Department Head.

Where only recreation leave is being directed, a shorter notice period of two (2) weeks is sufficient.

Other public sector agencies
Other public sector agencies are encouraged to review their industrial arrangements accordingly.
