The purpose of this Circular is to issue Guidelines on Disclosure of Information During Industrial Consultations. The Guidelines set out the requirements for disclosure of personal information set by the NSW Privacy and Personal Information Protection Act (1998).

The Guidelines recognise that Industrial Relations legislation and Occupational Health and Safety legislation may require personal information to be disclosed in certain circumstances.

Schedule 1 Agencies under the Public Sector Employment and Management Act 2002 are advised to adopt the Guidelines. Public sector agencies and State Owned Corporations are encouraged to adopt the Guidelines.

Advice from public sector unions, The NSW Privacy Commission and Government agencies was sought in developing these guidelines. The operation of the Guidelines will be reviewed by the Public Employment Office, in consultation with these parties in 12 months time.
