About

The NSW Attorney Generals Department, as the administrator of copyright across the NSW government, has separately developed a Copyright Management Toolkit to assist government agencies manage their copyright, primarily as it relates to publications (digital and hard-copy formats, including photographs, maps, CD ROMs, promotional materials etc) and websites.

Released in 2005, the Intellectual Property Management Framework for the NSW Public Sector was developed by the NSW Premiers Department to assist agencies manage their intellectual property (IP) effectively whether it is copyright, patents, trade marks or plant breeders rights. The Framework contains a set of mandatory IP Principles, which all general government sector agencies are required to implement. The Framework can be accessed from the Premier's Department website.

The Toolkit:

  • guides agencies in the creation and implementation of a copyright policy

  • provides templates that agencies can use to implement their copyright policy, and

  • identifies better practice.

The Toolkit addresses several of the 11 mandatory Principles laid out in the Intellectual Property Management Framework.

Agencies are strongly encouraged to use the Toolkit when developing or reviewing their publications and websites copyright policy. As a minimum, agencies should review the copyright notices on their publications and websites to ensure they reflect the better practice identified in the Toolkit. This will ensure that NSW Government information is made widely available to benefit the people of New South Wales, whilst ensuring that Government copyright is protected and commercialised when appropriate.

The Toolkit is attached and can also be accessed from the Attorney Generals Department website. The Attorney Generals Department also publishes a regular copyright newsletter to inform government agencies about copyright issues. Current and past issues of ©news can be found on the Attorney Generals Department website - www.lawlink.nsw.gov.au (Lawlink Agencies then Copyright Unit).
