The Retail Traders Association (RTA) and the Building Owners & Managers Association (BOMA) have recently agreed to establish an industry administered Code of Practice for retail tenancy leases. A copy is attached for your information.

As part of the agreement, the two associations will establish a joint RTA/BOMA Code Management Committee to oversight the implementation of the Code, as well as a dispute settling mechanism which will include mediation and determination. A Code Administrator will enforce the Code.

Although the Code is to be industry administered, Ministers will be aware that the Government has long had concerns regarding retail tenancy disputation. Accordingly, the Government has been involved in the negotiations which have led to the agreement by the RTA and BOMA. It is, therefore, desirable for the Code to be applied by all government and semi-government agencies which have retail tenancy arrangements.

In the circumstances, I should be pleased if you would request all agencies associated with your administration to adopt the Code.
