The procedures outlined in Memorandum 93/33 for advertising of Chief Executive and Senior Executive Service positions at the end of contracts have been reviewed and the following now apply

RENEWAL OF SES CONTRACTS

The presumption will be that positions will be advertised. However, contract renewal will be permitted where performance of a high standard has been satisfactorily demonstrated over the major part of the contract. However, only one extension, up to a maximum of five years, will be allowed before the market place must be tested for a particular Chief Executive Service/Senior Executive Service position.

For a Chief Executive, the initial decision to advertise, or to refer the matter for further review, will be taken by the relevant Minister. For a Senior Executive this decision will be taken by the CEO of the agency.

PROCESS OF REVIEW

The review process will be as follows
The basis of a decision to renew a contract of a CEO/SES incumbent is:

  • a demonstrated high standard of performance, based on an accredited performance management system;
  • on-going organisational need for the position; and
  • the competitiveness of the management market for the particular skills/knowledge/experience required for the position

 Timing

An in-depth review of the CES/SES officer would occur nine months before the contract was due to expire. A final decision would be made known to the officer no later than six months before the expiry date.

For CEOs and SES officers who have already been informed that their positions were to be advertised there will now be the option to undergo a review if the Minister or CEO so decides. The original decision to advertise will then be either confirmed or amended to allow renewal of contract.

Where recruitment action has already started the process is to continue in accordance with the merit principle.

Review Mechanisms

1. For all CEOs

(a) GTEs
The review would be by the Director General of Premier's, Chairperson of the Board and the relevant Minister.

(b) Other Agencies
The review would be by the Director General of Premier's, an independent and the relevant Minister.

2. For all SES officers

(a) GTEs
The review panel must include the CEO and at least one external board member.

(b) Other Agencies
The review panel must include the CEO and an independent from outside the public sector.
