It has come to my attention that the Commonwealth Government is seeking to tie projects funded from the Federation Fund, and other Commonwealth programs involving construction, to Deeds of Agreement to implement the National Code of Practice for the Construction Industry 1997, in the manner outlined in the Commonwealth Implementation Guidelines 1998.

I wish to confirm that the NSW Code of Practice for the Construction Industry continues to operate in this State. The National Code of Practice includes a provision which expressly acknowledges the right of the States to maintain their own Code of Practice or develop Codes to suit the priorities within their jurisdiction.

Accordingly, should any agencies be approached by the Commonwealth Government to sign Deeds of Agreement in relation to the application of the National Code and the Commonwealth Implementation Guidelines, they should in the first instance contact the Chair of the Construction Policy Steering Committee, Mr Ted Smithies, at the Department of Public Works and Services.
