Appointments to statutory positions are made under various pieces of enabling legislation however not all such Acts contain provisions as to the leave entitlements of appointees.

To avoid difficulties with statutory appointments made under different Acts, a consistent approach has been adopted for circumstances in which no specific provision exists in an enabling Act for the granting of various types of leave.

Appointments to statutory positions are made under various pieces of enabling legislation however not all such Acts contain provisions as to the leave entitlements of appointees.

To avoid difficulties with statutory appointments made under different Acts, a consistent approach has been adopted for circumstances in which no specific provision exists in an enabling Act for the granting of various types of leave.

In such circumstances, leave conditions will be formulated in the Instrument of Appointment. Persons recommended for appointment shall be entitled to the leave conditions applying under the Public Sector Management Act 1988, and Regulation made thereunder. A statement to this effect should be included in the Executive Council Minute recommending the appointment.

Your cooperation in bringing this matter to the attention of the appropriate sections of your administration would be appreciated.

This Memorandum supersedes Premier's Memorandum 85-51 on the issue of leave conditions applying to appointees to statutory positions.
