The Subordinate Legislation Act 1989 sets out various steps for public consultation in relation to proposed regulations, including regulatory impact statements (RIS).
If a regulation is subsequently made, sub-section 5(4) requires Ministers to forward a copy of any regulatory impact statement and any submissions received in relation to the proposed regulation, to the Legislation Review Committee within 14 days of the regulation's publication in the Gazette.
The Chairman of the Legislation Review Committee has expressed concern that this timeframe is not always being met.
Premier's Memorandum 1998-15, "Tabling of Regulatory Impact Statements", also establishes additional tabling requirements for regulatory impact statements and related documents.
It would be appreciated if you would bring this Memorandum to the attention of all Chief Executive Officers in your administration, requesting them to ensure that the requirements of sub-section 5(4) of the Subordinate Legislation Act and Memorandum 1998-15 are followed.
