Public sector mobility arrangements have been improved by amendments to the Public Sector Management Act 1988. The amendments are set out in the Public Sector Management Amendment (Mobility) Act 1996 which was assented to on 3 December 1996.
An outline of the key provisions is provided in the attachment to this Circular.
The main effect of the amendments is the introduction of a transfer scheme which provides a statutory basis for the Government's policy on redeployment of displaced employees across the public sector. The scheme supplements existing public service transfer arrangements by allowing:
- public servants to be transferred to public authorities;
- employees of public authorities to be transferred to the public service;
- employees of public authorities to be transferred to other public authorities;
- members of the SES to be transferred to a position at a lower level of remuneration, with the officer's consent.
For the head of an organisation to transfer staff to another organisation, the staff must be consulted, the head of the receiving organisation must agree and the Director-General, Premier's Department (exercising the powers of the PEO) must approve the transfer.
