PBD-2014-01C Construction procurement policies and procedures – interim arrangements

The NSW Procurement Board has agreed to review, consolidate and update all sector-wide relevant construction procurement policies and procedures. While this review is underway, the Board has confirmed that existing policies and procedures continue to apply, as set out in this Direction.

The NSW Procurement Board has agreed to review, consolidate and update all sector-wide relevant construction procurement policies and procedures. While this review is underway, the Board has confirmed that existing policies and procedures continue to apply, as set out in this Direction.

The purpose of the review is to repeal outdated policies, simplify policies and procedures to assist agencies and construction businesses engaged in NSW Government projects, and to ensure that the principles which have driven the Procurement Board’s reform of goods and services procurement are applied, where relevant, to construction and infrastructure projects.

The policies and procedures under review include the:

  • Code of Practice for Procurement 2004
  • Implementation Guidelines to the New South Wales Code of Practice for Procurement: Building and Construction 2013
  • Implementation Guidelines: NSW Government Procurement 1999
  • NSW Government Procurement Policy 2004 (TPP04-1 applies to construction only)
  • Agency Accreditation Scheme for Construction
  • Tendering Guidelines December 2011
  • Training Management Guidelines 2009
  • Industrial Relations Management Guidelines 1999
  • Aboriginal Participation in Construction Guidelines.

The Procurement Board has issued a number of Board Directions in relation to the procurement of goods and services. As part of the review will involve developing common policies and practices covering goods, services and construction-related procurement, the Board has decided that agencies should commence applying the following Board Directions to construction-related procurement, where not inconsistent with existing construction policies:

  • 2012-07 - Multi-agency access arrangements (authorising of prequalification and registration schemes, standing offers and panel contracts)
  • 2013-02 - Statement on the Promotion of Competition
  • 2013-04 - Scope for government agencies to support Aboriginal businesses
  • 2013-05 - Engagement of probity advisers and probity auditors
  • 2014-01 – Unconscionable conduct by suppliers.

The Procurement Board has also agreed that where it is not inconsistent with existing construction procurement policies' procedures listed above, agencies should generally apply the principles and approaches set out in the Procurement Policy Framework, which relates to the procurement of goods and services.  As part of this, agencies should adopt an approach to assessing value for money consistent with the Board’s Statement on Value for Money.

This Direction is issued by the NSW Procurement Board on 19 March 2014 and takes effect from 31 March 2014 until withdrawn.
