M2009-15 Staffing Freeze

Superseded by C2010-05. This memorandum has superseded Circular 2009-10, Memorandum 2008-21 and 2008-23. Related Circulars 2008-29, 2008-41, and 2009-01 remain current.

Detailed Outline

Effective from the date of this Memorandum, a freeze applies to:

  • filling of all non front line jobs
  • contingent labour including contractors and consultants (used as a substitute for recruitment action)
  • labour hire to fill temporary jobs
  • Executive Search hire to manage recruitment activity.

Jobs that are directly associated with capital works (except IT projects), Commonwealth stimulus funded programs and entry level jobs (apprenticeships, traineeships, cadetships and graduate programs) are exempt from the freeze.

Under limited circumstances an exemption may be given where a sound business case has been provided (including restructuring imperatives, associated savings strategies and a cost/benefit analysis). Exemption requests must be supported by the agency CEO or appropriate delegate. A central Employment Assessment Committee (EAC) has been established to approve all recruitment activity to jobs affected by the freeze. Restrictions apply to advertising jobs in the Greater Metropolitan Sydney area, other capital cities or national press (excluding community or cultural press eg Koori Mail). All requests to advertise in metropolitan or national press (for both front and non front line positions) must be referred to DPC for approval.

Agencies must seek approval from DPC to advertise any SES or executive contract positions.

This applies to all public sector agencies. This includes all agencies and employees in the Government Service (Public Service Departments, Non-Public Service Divisions and Special Employment Divisions), the Teaching Service, NSW Police and the NSW Health Service.

The Treasurer will write separately to State Owned Corporations concerning adoption of the provisions of this Memorandum.
