Since early 1991 provision has existed for organisations to enter into enterprise agreements which prevail over any award, industrial agreement or order of the NSW Industrial Relations Commission.

The Royal Commission Into Productivity in the Building Industry has revealed two types of fees which have been imposed on Government building and construction contracts without the Governments consent: special fees and unsuccessful tenderers' fees (UTFs).

Memorandum 92-18 of 6th July, 1992 which in part dealt with Private Office appointments required that Ministers seek the Premier's agreement before engaging for a private office position any person who was not employed in a Private Office on 24th June.

On Friday, 31st July, I announced a review by the Office of Public Management of the Premier's Department into the roles and responsibilities of non executive directors appointed by the Government to serve on the large number of organisations within the public sector.

The Building Industry Royal Commission Report includes the following recommendations: "I recommend that the appropriate New South Wales authority move for deregistration of the BWIU in both the Federal and New South Wales jurisdictions, or the closest appropriate remedy, bearing in mind the complication of the formation of the CFMEU and the coming into force, of the New South Wales (Industrial Relations) Act".

Following the findings and recommendations of the Royal Commission Into Productivity In The Building Industry, my memorandum no 92-11 requested all Ministers to take steps forthwith to ensure that the MBA and the BW1U are suspended from membership of any Boards, Commissions and Committees and any other consultative mechanisms associated with their administrations.
